Jury Finds that Boeing did not Discriminate Against African American Employees

SEATTLE - Today, December 21, 2005, the jury in the Williams case returned a verdict that Boeing did not intentionally discriminate against African American workers in promotions.

We are obviously very disappointed that the jury did not side with us. We feel that we presented the jury with a very compelling case that illustrated that Boeing was aware of inequity in the way they promoted. We can speculate why the jury didn't agree with us, but at the end of the day, they sided with Boeing and ruled against us.

We are investigating whether we have any grounds for appeal, but feel that the court has ruled fairly during the course of this case, which makes appeal very difficult.

This is terrible news for everyone who worked so hard on this and for all the members of the class who have helped us prepare for this case. To those people, we offer our thanks for the tireless work in getting this case to the jury.

Judge Pechman still must rule whether or not Boeing's employment policies negatively impact the class, a decision that could take months. We will send a follow-up newsletter once this decision is returned.

Calender, et al. vs. Boeing, et al.

We are evaluating how this jury's verdict may impact our approach to the Calender case, or if the verdict has a direct impact to the case at all. We will share more on this as the effect becomes clearer.

Please let us know if you have any questions.

We are committed to keeping class members abreast of developments in both cases. Please continue to check the Web site for information and important documents. You can also contact us directly at the numbers listed below.
